On the heels of JC's Avatar, M. Night is also planning on making a movie called Avatar, although his is based on the Nickolodeon cartoon. The only question is, whose will retain the title. A dude from Fox (producing JC's Avatar) said: "We own the movie title 'Avatar.' There won't be another film called 'Avatar' coming from anyplace."

I hate to break it to JC's producer, but there are no protections for titles. This means that M. Night can name his film Avatar if he wants...
Having said that, I'm sure money will change hands (or something like it) and somebody will come up with a alternative title.
You are totally correct about that. The cartoon has the subtitle The Last Airbender so maybe they'll add that in somehow.
Turns out Cameron/Fox don't exactly on the title to "Avatar" after all:
